Term Of Service

This Term Of Service is a legal agreement between you ("User", "you", or "your") and Glacier Jewel Up ("Company", "we", "us", or "our"), governing your use of our mobile application ("App") available through the Apple App Store.

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by this Agreement and our Privacy Policy. If you do not agree with these terms, do not download or use the App.

2. Eligibility

You must be at least 13 years old (or the minimum age in your country that allows legal consent) to use the App. If you are under the age of majority in your jurisdiction, your parent or legal guardian must review and accept this Agreement on your behalf.

3. License

We grant you a limited, non-exclusive, non-transferable, non-sublicensable license to download, install, and use the App on your personal device solely for your personal, non-commercial use, in accordance with this Agreement and the Apple Media Services Terms and Conditions.

4. Restrictions

You agree not to:

• Modify, reverse-engineer, or attempt to discover the source code of the App;
• Use the App for any unlawful or unauthorized purpose;
• Interfere with the proper functioning of the App;
• Use automated systems to access the App;
• Collect or harvest data from other users without their consent.

5. User Accounts

You may be required to register an account to access certain features. You agree to provide accurate, complete, and up-to-date information and to maintain the security of your account credentials. You are responsible for all activities under your account.

6. User Content

You are solely responsible for the content you upload, post, or otherwise make available via the App. You grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, distribute, and display such content in connection with the App’s operation.

7. Intellectual Property

All intellectual property rights in the App and its content, including but not limited to trademarks, logos, designs, text, graphics, and software, belong to us or our licensors. You may not use our trademarks without our prior written consent.

8. In-App Purchases

The App may offer in-app purchases. All purchases are processed by Apple, and subject to Apple’s payment terms. We do not have access to your billing information. In-app purchases are final and non-refundable unless otherwise required by law or Apple’s policy.

9. Subscription Terms

If the App offers subscriptions:

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period;
• Payment is charged to your Apple ID account;
• You may manage and cancel subscriptions through your device settings.

10. Third-Party Services

The App may link to or use services provided by third parties. We do not control and are not responsible for their content, policies, or practices. Your use of third-party services is at your own risk.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

13. Indemnity

You agree to indemnify and hold harmless the Company and its affiliates, directors, officers, and employees from any claims, losses, damages, liabilities, including legal fees, arising from your use of the App or violation of this Agreement.

14. Termination

We may suspend or terminate your access to the App at any time, without notice, if we believe you have violated this Agreement or applicable laws. Upon termination, all rights granted to you under this Agreement will cease.

15. Changes to this Agreement

We reserve the right to modify this Agreement at any time. We will notify you of changes by posting an updated version in the App or through other means. Continued use of the App constitutes your acceptance of the updated Agreement.

16. Governing Law

This Agreement is governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts in [Your Jurisdiction].

18. Apple-Specific Terms

This Agreement is between you and Glacier Jewel Up, not with Apple Inc. Apple is not responsible for the App or its content. Apple has no obligation to furnish any maintenance or support services with respect to the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever.

19. Severability

If any part of this Agreement is found to be invalid or unenforceable, that part will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

20. Entire Agreement

This Agreement constitutes the entire agreement between you and us regarding the App and supersedes all prior agreements and understandings related to the App.
